What is the waiting time for a work permit and a residence card?
The waiting time to get a work permit is typically from 1 to 1.5 months and depends upon the particular type of permission. The formalities associated with obtaining type A work permit take about 1.5 months because of the need to obtain prior starost information from the District Labour Office (the so called “opinion of the District Labour Office). However, if case of type B, C, D, E work permits, the waiting time is a maximum of 30 days. In exceptional cases this time can be shortened.

If I have a visa valid for another year, can I apply for a temporary residence card now?
The rules do not prohibit to apply for a temporary residence card immediately upon arriving in Poland, but in such cases usually at the time of granting the residence card the visa, which was the basis for coming to Polish, will be cancelled. It should also taken into account that the expiry date of the card will be the same as the expiry date of the visa.

I run a business as a natural legal person. The main department of my company is located in Bydgoszcz, and I myself have permanent registered residence in Warsaw. Where should I apply for a work permission for an employee who will perform work in Bydgoszcz?
The local jurisdiction to request a work permission is determined by the registered residence of the employer (art. 88b paragraph 1 of the Act of 20 April 2004 on promotion of employment and labour market institutions). In this case, the proper authority is the Viovode of Mazowsze. The application will need to indicate the place of work, in this case Bydgoszcz.

What size should the pictures to a temporary residence card have?
For applications above, have to be attached: 4 actual, undamaged, colorful photos at 35 x 45 millimeter size, taken during last 6 months on self and light background, with good focus and showing eyes and face from the top of the head to the top of the shoulders, 70-80% of the photo must be occupied by a face; a person on the photo must be without head covering or dark glasses, looking straight ahead with open eyes, not covered by hair, with natural face expression and closed mouth.
If a person has a congenital or no congenital eyes defects, may attach to application photos with dark glasses and a person who is wearing a head covering because of religious principles may attach photos with a head covering. This kind of a head covering can not covering or deforming face oval.

A month ago I applied for a temporary residence card at the Mazowsze Viovodeship Office in Warsaw. Yesterday a police officer came to my house without notice and asked questions about my stay in Poland. Is there something wrong with my application?
The procedure for granting permission for residence for a specified period of time begins with sending the file to three bodies: the Border Guard, Internal Security Agency and the Police. The responsibilities of the Police are, among others, to determine whether the foreigner is actually present at the address indicated in the application. This is standard procedure in cases for a temporary residence card. Unfortunately, the Police visits are almost always unannounced.

I am a citizen of Ukraine, working in Poland on the basis of a statement of the employer and the intention give work to a foreigner. My visa ends on December 31, 2010. What can I do to be able to continue my work in Poland?
The permission to perform work under the employer’s declaration of an intention give work to foreigner, which make it easier for certain foreigners wishing to work in Poland, was introduced on the basis of the regulation of the Minister of Labour and Social Policy of 30 August 2006 on the performance of work by foreigners without the need to obtain a work permission. The statements are a pilot programme and are valid until 31 December 2010. In this respect, the foreigner, who wishes on the continue working, should apply for work permission in Poland by the end of November 2010.

I have a Kyrgyz driving license, I would like to exchange it for a Polish one. Is this possible and how long will the exchange of a document take?
In accordance with current international agreements, Kyrgyz driving license can be exchanged for Polish one. The waiting time for the Polish driving license depends primarily on the institution issuing the document in Kyrgyzstan, which is required to certify its authenticity. In this particular case, the procedure will be significantly longer, as in Kyrgyzstan there is no Polish Embassy, which makes it necessary to send documents via a Consulate in Kazakhstan. Sometimes, it faster and easier to obtain proper certification on ones own than to wait for a response of the proper institution.

I am a citizen of Poland, I would like to marry a citizen of Brazil. We live together with my fiancé in Warsaw for a year now, but have set a wedding date for future summer holidays. As the bride may be present in Poland only 90 days without a visa, I would like to obtain a temporary residence card for her. Is this possible?
Article 53a paragraph 1 point 4 of the Act of 13 June 2003 on foreigners provides the opportunity to apply for a temporary residence card on the basis of “other circumstances”. Our experience shows that such a circumstance is, among others, an intention of marrying a Polish citizen. The basis for obtaining a residence card is presenting a certificate from the Civil Registry Office on the scheduled date for the wedding. In the case of a female citizen of Brazil, it will also be necessary to obtain an exemption from the obligation of submitting a certificate of legal capacity be married from the Family Division of the District Court. Due to the long period of waiting for an appointment for a hearing at the District Court, in the case of Brazilian citizens applying for a residence card should be made well in advance.
